Following the ongoing Presidential Election Tribunal, Court has Dismissed Peter Obi, LP’s Petition On Election Results Transmission.
GoldenNewsNg reports that the Presidential Election Petition Court has ruled that the Independent National Electoral Commission (INEC) can choose how it wants to send election results, not just through electronic means.
When it comes to how election results are sent, the court said that INEC can decide for itself.
In the past, Peter Obi and the Labour Party argued in their petitions that INEC didn’t use electronic means to send results from polling units to collation centers during the 2023 presidential election, which Bola Tinubu won.
However, on Wednesday, the court said there’s no law that requires INEC to only use electronic means to send results from polling units.
The court stated that INEC has the freedom to decide how it sends election results and that the law gives INEC the authority to choose how election results are collected in Nigeria.
The court also made it clear that there’s no obligation for INEC to use electronic methods to transmit election results.
According to the Electoral Act’s Section 52 and Section 65, INEC has the freedom to decide how results are transmitted, and it cannot be forced to use electronic methods, the court concluded.
